Internet Marketing Assistance
OfficeMax.com cancelled my order. What legal rights do I have?
I am living in new jersey, USA. I ordered a laptop through internet on officeMax.com.
I received order confirmation email. 2 days later I received an email from sales manager of officeMax.com saying — “Order # is discontinued and will no longer be carried by OfficeMax. The inventory has been exhausted in your market area. Regretfully, we have cancelled that item from your order without charge to you. If we can be of further assistance, please contact…..xxxxxxxxx”.
Note that my credit card has not been charged till date, but the deal offered on the website of officemax was so good that I do not want to lose that offer.
I called the officemax customer service & asked them to offer some other deal , atleast in same price, but they refused.
Can I take a legal action against officemax.com ? Can anybody provide me more details on this or related to this?
You’re likely SOL. Sale ads (online or print) usually include a clause that says something to the effect of “subject to availability”. Same thing if you saw a great deal in the paper and they’d run out.
You can ASK for a raincheck (for the same item), but if they’re not getting more in stock…
