Small business…W-2 or Form 4852 or 1099-Misc?
Small business employer with 4 employees used payroll service (ADP, PayChex etc.) for part of the year, and then used manual payroll (internal spreadsheets) for the rest of the year. Payroll service provided the 4 employees with W-2 statements for periods within 2008 that service was used.
Should the employer also provide W-2 for the remaining periods of 2008?
Should the employer file the W-2 online with SSA (I guess a late fee will apply since it is past the deadline)?
Or should employer give the employees Form 4852 (substitute W-2) or 1099-Misc?

If you are the employer, get the W-2s done NOW. You will already be hit with late fees, but at least you will fulfill your obligation.
If you are the employer, yo do NOT cheat and issue a 1099-Misc. This isn’t allowed and when you get caught, you will have a 100% trust fund penalty for all the money you were supposed to send in for the W-2 anyway.
If you are the employee, call the IRS and ask for the letter to be sent re missing W-2. Then wait 1-2 weeks. If still no W-2, then do the 4852.
If you are the employee and you get the 1099-Misc, grab form SS-8 and form 8919 and only pay your share.
